OUTDOOR ENERGY ADVENTURES
ASSUMPTION OF RISK, RELEASE OF LIABILITY AND PARTICIPANT AGREEMENT

Outdoor Energy Adventures (“OEA”) is a private, invitation-only social group that coordinates and shares information about recreational, outdoor, adventure, and social activities. Participation in any OEA event is voluntary.
By registering for, RSVPing to, attending, or participating in an OEA event, I acknowledge and agree to the following:
1. VOLUNTARY PARTICIPATION
I understand that my participation in any OEA event or activity is entirely voluntary. I am responsible for determining whether I am physically, mentally, and otherwise capable of safely participating in the activity.
I understand that OEA organizers, administrators, event hosts, volunteers, and other participants are not acting as professional guides, instructors, medical professionals, safety personnel, or transportation providers unless expressly stated otherwise.
2. ASSUMPTION OF RISK
I understand that outdoor, recreational, adventure, sporting, travel, and social activities involve inherent and other risks that may result in property damage, illness, serious bodily injury, permanent disability, or death.
Depending upon the activity, risks may include, but are not limited to:
- drowning or immersion;
- boating, kayaking, canoeing, paddleboarding, or other water-related accidents;
- currents, tides, waves, changing water levels, submerged objects, marine life, and water conditions;
- hiking, climbing, uneven terrain, roots, rocks, holes, slippery surfaces, and falling objects;
- cycling and collisions with vehicles, bicycles, pedestrians, animals, or stationary objects;
- camping and exposure to fire, wildlife, insects, plants, weather, and remote locations;
- ATV, off-road vehicle, or other motorized recreational activity;
- falls, collisions, cuts, sprains, fractures, head injuries, and other physical injuries;
- extreme heat, cold, lightning, storms, sun exposure, dehydration, and other weather conditions;
- equipment failure or improper use of equipment;
- actions or negligence of other participants, members of the public, property owners, vendors, guides, outfitters, or other third parties;
- transportation to or from an event;
- delayed access to emergency medical treatment;
- illness, allergic reaction, or other medical emergency; and
- risks that may presently be unknown or not reasonably foreseeable.
I knowingly and voluntarily accept and assume all risks associated with my participation, whether known or unknown and whether arising from natural conditions, my own actions, the actions of others, or otherwise.
3. RELEASE AND WAIVER OF LIABILITY
To the fullest extent permitted by Florida law, I voluntarily RELEASE, WAIVE, AND DISCHARGE Outdoor Energy Adventures and its organizers, administrators, event hosts, volunteers, representatives, members, agents, and affiliated persons or entities (collectively, the “Released Parties”) from any and all claims, demands, causes of action, damages, losses, liabilities, costs, or expenses arising from or related to my attendance at or participation in an OEA event.
This release includes claims for bodily injury, illness, death, emotional injury, property damage, loss, or other harm arising from the inherent risks of an activity or from the ordinary negligence of any Released Party, to the fullest extent such a release is permitted under Florida law.
I understand that by agreeing to this provision, I may be giving up important legal rights, including the right to bring a lawsuit against a Released Party for injuries or damages that may occur during an OEA event.
This agreement is not intended to release liability that cannot legally be waived under applicable law.
4. THIRD-PARTY ACTIVITIES AND PROVIDERS
OEA may organize events that involve businesses or third-party providers, including outfitters, rental companies, tour operators, parks, campgrounds, restaurants, transportation providers, lodging providers, guides, or recreational facilities.
Unless expressly stated otherwise, these providers are independent third parties and are not owned, operated, supervised, controlled, or endorsed by OEA.
OEA does not warrant or guarantee the safety, condition, qualifications, services, equipment, personnel, insurance, licensing, or performance of any third-party provider.
A third-party provider may require me to sign an additional waiver or agreement. Any such agreement is separate from this OEA Participant Agreement.
5. PERSONAL RESPONSIBILITY
I agree that I am personally responsible for:
- evaluating whether an activity is appropriate for me;
- following reasonable safety instructions;
- using appropriate clothing, footwear, protective equipment, and safety gear;
- bringing sufficient food, water, medication, and personal supplies;
- properly operating any equipment I own, rent, borrow, or use;
- complying with applicable laws, regulations, park rules, facility rules, and instructions from third-party operators;
- monitoring weather and environmental conditions;
- exercising reasonable judgment regarding my own safety; and
- withdrawing from an activity whenever I believe conditions exceed my abilities or comfort level.
I will not participate while impaired by alcohol, illegal drugs, or any substance that materially affects my ability to participate safely.
6. MEDICAL CONDITIONS AND EMERGENCY CARE
I am responsible for determining whether my health permits me to participate safely.
I understand that OEA does not provide medical evaluations or medical advice and is not responsible for determining my fitness to participate.
If I require emergency medical assistance and am unable to provide consent, I authorize reasonable efforts to obtain emergency medical care on my behalf.
I understand that I am responsible for any medical, transportation, evacuation, rescue, or related expenses incurred on my behalf.
7. EQUIPMENT
Unless expressly stated otherwise, each participant is responsible for selecting, inspecting, maintaining, and safely using his or her own equipment or any rented equipment.
OEA does not warrant the safety or suitability of equipment owned, rented, loaned, or supplied by another participant or third-party provider.
8. TRANSPORTATION
Participants are generally responsible for arranging their own transportation to and from OEA events.
Any carpooling or transportation arranged between participants is voluntary and is not transportation operated or provided by OEA.
I assume the risks associated with transportation to and from an event and understand that OEA is not responsible for the operation, condition, insurance, or safety of privately operated vehicles.
9. EVENT CHANGES AND CANCELLATIONS
Outdoor activities may be affected by weather, water conditions, facility closures, availability, safety concerns, participation levels, or other circumstances.
OEA may modify, postpone, relocate, or cancel an event at any time.
Participants remain responsible for understanding and complying with the cancellation, refund, or rescheduling policies of any third-party provider.
OEA is not responsible for nonrefundable expenses incurred by a participant in connection with an event unless expressly agreed otherwise.
10. NO GUARANTEE OF SUPERVISION OR SAFETY
An OEA event host or organizer may coordinate logistics, meeting locations, schedules, or group communications, but this does not create a duty to supervise or continuously monitor participants.
Each participant remains responsible for his or her own decisions and safety.
No representation that an activity, route, facility, provider, or location is “safe,” “easy,” “beginner-friendly,” or similar terminology should be interpreted as a guarantee that injury cannot occur.
11. CONDUCT
Participants are expected to behave responsibly and respectfully toward other participants, members of the public, property owners, vendors, and event personnel.
OEA may remove or exclude a participant from an event or from future OEA activities when the participant's conduct creates a safety concern, substantially disrupts an event, violates applicable rules, or is inconsistent with the nature of the group.
12. PHOTOGRAPHY AND MEDIA
OEA events may be photographed or recorded.
Unless I notify an OEA organizer that I do not wish to be photographed, I grant OEA permission to use photographs or video in which I appear for OEA's website, event gallery, social media, and other noncommercial group communications.
I understand that OEA cannot control photographs or recordings independently made or published by other participants or members of the public.
13. PERSONAL PROPERTY
I am solely responsible for my personal property.
OEA is not responsible for lost, stolen, damaged, or destroyed vehicles, equipment, electronics, clothing, or other personal property brought to an event.
14. INDEMNIFICATION
To the fullest extent permitted by applicable law, I agree to indemnify and hold the Released Parties harmless from claims, liabilities, damages, costs, or expenses resulting from my own actions, misconduct, violation of law, or damage I cause to another person or property during an OEA activity.
15. GOVERNING LAW
This agreement shall be governed by and interpreted under the laws of the State of Florida.
Any dispute arising from this agreement or participation in an OEA activity shall be brought in a court of competent jurisdiction in Florida, subject to applicable law.
16. SEVERABILITY
If any provision of this agreement is determined to be invalid or unenforceable, that provision shall be enforced to the maximum extent permitted by law, and the remaining provisions shall remain in effect.
17. ACKNOWLEDGMENT
By RSVPing to or participating in an OEA event, I confirm that:
- I have read this agreement;
- I understand its terms;
- I understand that outdoor and recreational activities can result in serious injury or death;
- I knowingly and voluntarily assume those risks;
- I understand that this agreement contains a release of liability;
- I understand that I may be giving up legal rights by accepting it; and
- I voluntarily agree to be bound by its terms.
